Terms of Service

These Terms govern access to and use of Evalyo, a recruitment platform covering job post creation and distribution, application screening, tests and interviews and decision tracking, and offering candidates a space to practice and search for jobs.

1. Purpose and definitions

These Terms of Service (the "Terms") govern access to and use of the Evalyo platform, available at evalyo.fr, published by the company Evalyo (hereinafter "Evalyo", "we").

Definitions:

  • Platform: the evalyo.fr website and all associated services (API, voice agents, test studio).
  • Organization: an entity (company, agency, school, training body) with a dedicated workspace on the Platform; also referred to as a "Tenant".
  • Member: a natural person attached to an Organization with an assigned role (Owner, Administrator, Member, Reader).
  • Individual user: any person registered in a personal capacity, without being attached to an Organization.
  • Candidate: a natural person taking part in interviews, tests or training sessions on the Platform, invited by an Organization or registered of their own accord.
  • AI Agent: a voice or text assistant powered by artificial intelligence, configurable by the Organization or the User.
  • Studio: the workspace for creating and managing AI agents, tests and interview configurations.

2. Acceptance of the terms

Access to and use of the Platform imply full and complete acceptance of these Terms. By creating an account, whether as an individual, as a Member of an Organization, or as a Candidate, you declare that you have read and accept these conditions in their entirety. If you do not accept these conditions, please do not use our services.

3. Description of the services

Evalyo is a recruitment platform covering the process end to end: job post creation and distribution, application screening, tests and interviews, reports and decision tracking. Depending on the user profile and the subscribed plan, the Platform allows users to:

For Organizations and their Members:

  • Create job posts, publish them on a public career space and distribute them to partner job platforms (see Article 3 bis).
  • Analyze and screen applications against a weighted criteria grid configured by the Organization, with the reasoning behind each rating.
  • Generate and administer tests (technical, knowledge, logic, personality) from a catalog or created on demand, as well as interviews, including interviews conducted by voice AI agents.
  • Generate structured reports and summaries and share them, including through an external link under the Organization's responsibility.
  • Track the candidate pipeline, collaborate between Members and document decisions.
  • Manage the Organization's members, roles, usage and quotas.
  • Access the services through the documented API and official integrations, using personal access keys, within the associated scopes and usage limits.

For Candidates:

  • Take part in interviews, tests and assessments sent by Organizations.
  • Practice independently: interview simulations, training tests, help with CV writing.
  • Search for job offers, including offers from third-party sources (applications are then made by redirection to the source, whose terms apply), and receive alerts.
  • Generate their own tests and preparation sessions (depending on the plan subscribed to).
  • Manage their profile and privacy preferences.

3 bis. Job post distribution and publication

3 bis.1 Distribution mandate. When an Organization activates the distribution of a job post, it authorizes Evalyo to transmit the content of the post, together with its name or company name and, where applicable, its logo and SIRET number, to partner distribution platforms (including Jooble, Adzuna, Talent.com, WhatJobs, Jobrapido, Trovit, Google for Jobs, and any platform subsequently integrated). Each platform applies its own terms and editorial policies: Evalyo does not guarantee the publication, timing, positioning or exposure duration of job posts on those platforms.

3 bis.2 Public publication. Distributed job posts and the Organization's career space are public and may be indexed by search engines. The Organization authorizes Evalyo to reproduce its name, logo and job post content for that purpose.

3 bis.3 Organization warranties. The Organization is solely responsible for the content of its job posts and warrants their lawfulness, including compliance with labor law, with the requirements applicable to job advertisements (no discriminatory statements or unlawful conditions) and with third-party rights. It holds Evalyo harmless against any claim in this respect. Evalyo may suspend or remove without notice any post that is manifestly unlawful or flagged by a partner platform.

3 bis.4 Unpublication. If a post is deleted or an account is terminated or suspended, Evalyo notifies partner platforms of the unpublication. The Organization acknowledges that effective removal on third-party platforms, including their caches and indexes, may take a reasonable time and is beyond Evalyo's control.

4. Accounts, Organizations and roles

4.1 Account creation. To use Evalyo, you must create an account by providing accurate, complete and up-to-date information. You are responsible for the confidentiality of your credentials and for all activities carried out under your account.

4.2 Organizations. A User may create an Organization or be invited to join an existing Organization. Each Organization has its own isolated workspace (agents, tests, candidates, reports). The Owner of the Organization is responsible for managing its Members and for compliance with these Terms within their Organization.

4.3 Roles within an Organization. Members are assigned a role that determines their permissions:

  • Owner: full access, management of billing and members.
  • Administrator: management of agents, tests and members (excluding billing).
  • Member: creation and use of agents and tests.
  • Reader: viewing of results and reports only.

4.4 Candidate account. Candidates have a separate personal workspace. They may be attached to several Organizations at the same time without those Organizations having access to data from the other Organizations. Candidates may also subscribe to an individual plan (Free, Pro, Expert) to access additional features.

4.5 Multi-organization. A User may be a Member of several Organizations and switch between them. The data of each Organization is strictly partitioned.

5. Subscriptions, plans and billing

5.1 Organization plans. Evalyo offers Organizations two subscription plans, whose current prices are displayed on the Pricing page: Solo, at 79 euros excl. VAT per month for 1 user, and Team, at 199 euros excl. VAT per month including 3 users, with each additional seat billed 66 euros excl. VAT per month. A Custom plan is available on quotation. Each plan defines usage quotas (interviews, tests, members, sessions) specified at the time of subscription.

5.2 Candidate purchases. Candidates may purchase fixed-price packs, displayed inclusive of tax before payment, crediting usage quotas valid for 12 months from purchase.

5.3 Trial period. A free trial period may be offered. At the end of this period, a paid subscription is required to continue using the relevant features.

5.4 Billing. Payments are processed by Stripe. Subscriptions are billed monthly or annually depending on the User's choice and renew automatically until cancelled. All invoices are available from the account management space. Evalyo may revise its prices: any revision is notified at least 30 days before it takes effect and applies to the next billing period.

5.5 Quota overage. Depending on the configuration chosen by the Organization, exceeding quotas may either block access to the relevant features or result in additional billing at the prevailing rate.

5.6 Right of withdrawal (consumers). In accordance with Articles L.221-18 et seq. of the French Consumer Code, a consumer Candidate has fourteen days from purchase to withdraw, without giving reasons, by writing to [email protected]. If they request immediate performance of the service before the end of that period, they may withdraw as long as the service has not been fully performed and then only owe the price corresponding to the service already provided; they acknowledge losing their right of withdrawal once the service has been fully performed with their prior express consent.

5.7 Consumer mediation. In accordance with Articles L.612-1 et seq. of the French Consumer Code, a consumer Candidate may use a consumer mediator free of charge to seek an amicable resolution of any dispute. The contact details of the competent mediator are available on request at [email protected] and will be published on this page once appointed.

5.8 Detailed terms of sale. The general terms of sale applicable to professional clients are provided on request at [email protected], in accordance with Article L.441-1 of the French Commercial Code.

6. Acceptable use

You undertake to use the Platform in a lawful and ethical manner. It is strictly prohibited to:

  • Use the service for unlawful, fraudulent or discriminatory purposes.
  • Attempt to access the data of other Users, Organizations or Candidates.
  • Disrupt the operation of the Platform or its infrastructure.
  • Use unauthorized bots, automated scripts or scraping tools.
  • Misuse the AI agents for unintended purposes (generation of unlawful content, harassment, manipulation).
  • Share or resell access to your account or your Organization.
  • Use assessment results as the sole decision criterion in a recruitment process without human intervention.

7. Artificial intelligence and automated processing

7.1 Nature of processing. Evalyo uses artificial intelligence systems (including OpenAI models for language and transcription, ElevenLabs for speech synthesis and LiveKit for real-time audio) to draft job posts, analyze applications, conduct interviews, assess skills and generate reports. This processing is automated and remains under the Users' control.

7.2 Recordings. The following sessions are audio-recorded and transcribed: interviews conducted by an AI agent, Candidate practice sessions and, where the feature is enabled, video interviews between a recruiter and a Candidate. Each participant is informed before the session starts of the recording and its purposes, and may decline to take part: a Candidate's refusal has no consequence other than the session not taking place. The details (legal bases, retention periods, rights) are set out in the Privacy Policy. A Candidate's practice recordings are accessible to that Candidate only.

7.3 Decision support and human oversight. All outputs produced by the Platform, including scores, weighted-grid ratings, assessments, CV analyses, test results, interview summaries, reports, rankings and recommendations, whether generated in whole or in part by artificial intelligence systems, are exclusively decision-support aids intended to inform human judgment.

Under no circumstances do these outputs replace the decision of the recruiter, the Organization or any other authorized person. Recruitment, selection, assessment, training or guidance decisions concerning a Candidate remain the sole and entire responsibility of the Organization and its Members, including where such decisions rely on outputs produced by the Platform. It is neither Evalyo's role nor its purpose to make, directly or indirectly, any recruitment decision or any other decision producing legal effects or similarly significant effects concerning a Candidate.

The Organization undertakes to maintain effective human oversight of the Platform's outputs at every stage of its process: any person using these outputs must be able to review them, put them into context, supplement them and, where appropriate, set them aside. In accordance with Article 6 of these Terms, using the Platform's outputs as the sole criterion for a decision, without human intervention, is prohibited. This requirement is consistent with Article 22 of the GDPR and with the obligations applicable to artificial intelligence systems used in the field of employment under Regulation (EU) 2024/1689.

7.4 No training on your data. The data from your interviews and assessments is not used to train or improve third-party AI models. It is only transmitted to the AI providers for the real-time processing of your session.

8. Intellectual property

8.1 Evalyo content. All elements of the Platform (source code, design, logos, texts, algorithms) are the exclusive property of Evalyo and are protected by intellectual property laws. Any unauthorized reproduction is strictly prohibited.

8.2 User content. You retain ownership of the content you create on the Platform (custom agents, tests, questions, configurations). By using Evalyo, you grant us a limited license to use this content solely for the purpose of operating the service.

8.3 Third-party job listings. The /emplois page aggregates, alongside listings from Evalyo's client Organizations, listings published by France Travail, reused under the France Travail job offers database reuse licence. These listings remain the property of France Travail and the relevant employers; Evalyo's reuse is limited to distributing them and helping Candidates prepare their applications, with no resale or sublicensing to any third party.

9. Personal data and privacy

9.1 Data controller. Evalyo is the controller of the personal data collected via the Platform, in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (loi Informatique et Libertés).

9.2 Processor. When an Organization uses Evalyo to assess Candidates, the Organization acts as data controller for its Candidates' data. Evalyo acts as a processor within the meaning of the GDPR. The data processing agreement governing this relationship is provided on request at [email protected].

9.3 Hosting and providers. Data is hosted in the European Union (Google Cloud Platform, europe-west1 region). Evalyo also uses the following providers: Cloudflare (network security, CDN and file storage), OpenAI (language processing and transcription), ElevenLabs (speech synthesis), LiveKit (real-time audio), Resend (transactional emails) and Stripe (payments). The applicable safeguards, including for any transfers outside the European Union, are detailed in the Privacy Policy.

10. Data partitioning and security

The data of each Organization is strictly partitioned. No Organization can access the data, agents, tests or results of another Organization. Candidates attached to several Organizations only see the data relating to each of them separately.

Evalyo implements appropriate technical and organizational security measures to protect your data: encryption of communications (TLS), secure authentication (JWT), role-based access control and access logging.

11. Limitation of liability

Evalyo strives to maintain an available, quality service, but does not guarantee the absence of interruptions, errors or defects. Evalyo cannot be held liable for:

  • Indirect damages resulting from the use of, or inability to use, the service.
  • Decisions made on the basis of assessments generated by AI.
  • Interruptions due to third parties (AI providers, host, telecom operators).
  • The loss of data resulting from a fault by the User or from a case of force majeure.

Evalyo's total liability, on all grounds combined, is limited to the amount of the sums actually paid by the User during the twelve (12) months preceding the triggering event.

12. Termination

12.1 By the User. You may terminate your account or your subscription at any time from your account settings. Termination takes effect at the end of the current billing period. No pro rata refund will be made.

12.2 By the Owner of an Organization. The Owner may delete the Organization and all of its associated data. Members will be informed by email.

12.3 By Evalyo. Evalyo reserves the right to suspend or terminate an account or an Organization in the event of a breach of these Terms, non-payment, or misuse of the Platform, after prior notice except in the case of an emergency.

13. Changes to the Terms

Evalyo reserves the right to modify these Terms at any time. Users will be informed of substantial changes at least fifteen (15) days before they take effect, by email or via a notification on the Platform. Continued use after that date constitutes acceptance of the new conditions.

14. Governing law and dispute resolution

These Terms are governed by French law. In the event of a dispute, the parties will endeavour to find an amicable solution. Failing that, any dispute between Evalyo and a professional client relating to the interpretation or performance of these Terms falls within the exclusive jurisdiction of the courts of Lyon (France), where the company has its registered office, including for interim proceedings and notwithstanding multiple defendants. This jurisdiction clause does not apply to consumer Users, who may bring proceedings before the territorially competent court under ordinary law.

In accordance with article L.612-1 of the French Consumer Code, consumers may use a consumer mediator free of charge with a view to the amicable resolution of the dispute.
