Terms of Service

These Terms govern access to and use of Evalyo, a skills assessment and development platform powered by artificial intelligence.

1. Purpose and definitions

These Terms of Service (the "Terms") govern access to and use of the Evalyo platform, available at evalyo.fr, published by the company Evalyo (hereinafter "Evalyo", "we").

Definitions:

  • Platform: the evalyo.fr website and all associated services (API, voice agents, test studio).
  • Organization: an entity (company, agency, school, training body) with a dedicated workspace on the Platform; also referred to as a "Tenant".
  • Member: a natural person attached to an Organization with an assigned role (Owner, Administrator, Member, Reader).
  • Individual user: any person registered in a personal capacity, without being attached to an Organization.
  • Candidate: a natural person taking part in interviews, tests or training sessions on the Platform, invited by an Organization or registered of their own accord.
  • AI Agent: a voice or text assistant powered by artificial intelligence, configurable by the Organization or the User.
  • Studio: the workspace for creating and managing AI agents, tests and interview configurations.

2. Acceptance of the terms

Access to and use of the Platform imply full and complete acceptance of these Terms. By creating an account, whether as an individual, as a Member of an Organization, or as a Candidate, you declare that you have read and accept these conditions in their entirety. If you do not accept these conditions, please do not use our services.

3. Description of the services

Evalyo is a skills assessment and development platform powered by artificial intelligence. Depending on the user's profile and the plan subscribed to, the Platform allows you to:

For Organizations and their Members:

  • Create and configure voice AI agents to conduct automated interviews.
  • Design custom tests (technical, personality, logic, knowledge).
  • Assess candidates or employees against customizable criteria.
  • Organize training and practice sessions for teams.
  • Generate detailed assessment reports and skills analyses.
  • Manage the Organization's members and assign roles.
  • Track usage and quotas via a dashboard.

For Candidates:

  • Take part in voice interviews and tests sent by Organizations.
  • Practice independently with interview simulations.
  • View their results, reports and progress.
  • Create their own tests and practice sessions (depending on the plan subscribed to).
  • Manage their profile and privacy preferences.

4. Accounts, Organizations and roles

4.1 Account creation. To use Evalyo, you must create an account by providing accurate, complete and up-to-date information. You are responsible for the confidentiality of your credentials and for all activities carried out under your account.

4.2 Organizations. A User may create an Organization or be invited to join an existing Organization. Each Organization has its own isolated workspace (agents, tests, candidates, reports). The Owner of the Organization is responsible for managing its Members and for compliance with these Terms within their Organization.

4.3 Roles within an Organization. Members are assigned a role that determines their permissions:

  • Owner: full access, management of billing and members.
  • Administrator: management of agents, tests and members (excluding billing).
  • Member: creation and use of agents and tests.
  • Reader: viewing of results and reports only.

4.4 Candidate account. Candidates have a separate personal workspace. They may be attached to several Organizations at the same time without those Organizations having access to data from the other Organizations. Candidates may also subscribe to an individual plan (Free, Pro, Expert) to access additional features.

4.5 Multi-organization. A User may be a Member of several Organizations and switch between them. The data of each Organization is strictly partitioned.

5. Subscriptions, plans and billing

5.1 Organization plans. Evalyo offers several plans for Organizations: Pro, Business and Enterprise. Each plan defines usage quotas (number of interviews, tests, members and training sessions per month).

5.2 Candidate plans. Candidates have individual plans (Free, Pro, Expert) offering different levels of access to the practice and test-creation features.

5.3 Trial period. A free trial period may be offered. At the end of this period, a paid subscription is required to continue using the relevant features.

5.4 Billing. Payments are processed by Stripe. Subscriptions are billed monthly or annually according to the User's choice. All invoices are available from the account management area.

5.5 Quota overage. Depending on the configuration chosen by the Organization, exceeding quotas may either block access to the relevant features or result in additional billing at the prevailing rate.

6. Acceptable use

You undertake to use the Platform in a lawful and ethical manner. It is strictly prohibited to:

  • Use the service for unlawful, fraudulent or discriminatory purposes.
  • Attempt to access the data of other Users, Organizations or Candidates.
  • Disrupt the operation of the Platform or its infrastructure.
  • Use unauthorized bots, automated scripts or scraping tools.
  • Misuse the AI agents for unintended purposes (generation of unlawful content, harassment, manipulation).
  • Share or resell access to your account or your Organization.
  • Use assessment results as the sole decision criterion in a recruitment process without human intervention.

7. Artificial intelligence and automated processing

7.1 Nature of the processing. Evalyo uses artificial intelligence models (notably GPT by OpenAI and Whisper for voice recognition) to conduct interviews, analyze responses, assess skills and generate reports. This processing is carried out in an automated manner.

7.2 Audio recordings. Voice interview sessions are recorded to enable transcription and analysis. Candidates are informed of this before the start of each session and may consent to or refuse it.

7.3 Limits of AI. Assessments generated by AI constitute decision-support aids and not final decisions. Evalyo recommends that human intervention be maintained in any recruitment or assessment process.

7.4 No training on your data. The data from your interviews and assessments is not used to train or improve third-party AI models. It is only transmitted to the AI providers for the real-time processing of your session.

8. Intellectual property

8.1 Evalyo content. All elements of the Platform (source code, design, logos, texts, algorithms) are the exclusive property of Evalyo and are protected by intellectual property laws. Any unauthorized reproduction is strictly prohibited.

8.2 User content. You retain ownership of the content you create on the Platform (custom agents, tests, questions, configurations). By using Evalyo, you grant us a limited license to use this content solely for the purpose of operating the service.

9. Personal data and privacy

9.1 Data controller. Evalyo is the controller of the personal data collected via the Platform, in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (loi Informatique et Libertés).

9.2 Processor. When an Organization uses Evalyo to assess Candidates, the Organization acts as the controller for its Candidates' data. Evalyo acts as a processor within the meaning of the GDPR.

9.3 Hosting. The data is hosted in Europe (Google Cloud Platform, europe-west1 region) in accordance with GDPR requirements.

10. Data partitioning and security

The data of each Organization is strictly partitioned. No Organization can access the data, agents, tests or results of another Organization. Candidates attached to several Organizations only see the data relating to each of them separately.

Evalyo implements appropriate technical and organizational security measures to protect your data: encryption of communications (TLS), secure authentication (JWT), role-based access control and access logging.

11. Limitation of liability

Evalyo strives to maintain an available, quality service, but does not guarantee the absence of interruptions, errors or defects. Evalyo cannot be held liable for:

  • Indirect damages resulting from the use of, or inability to use, the service.
  • Decisions made on the basis of assessments generated by AI.
  • Interruptions due to third parties (AI providers, host, telecom operators).
  • The loss of data resulting from a fault by the User or from a case of force majeure.

Evalyo's total liability, on all grounds combined, is limited to the amount of the sums actually paid by the User during the twelve (12) months preceding the triggering event.

12. Termination

12.1 By the User. You may terminate your account or your subscription at any time from your account settings. Termination takes effect at the end of the current billing period. No pro rata refund will be made.

12.2 By the Owner of an Organization. The Owner may delete the Organization and all of its associated data. Members will be informed by email.

12.3 By Evalyo. Evalyo reserves the right to suspend or terminate an account or an Organization in the event of a breach of these Terms, non-payment, or misuse of the Platform, after prior notice except in the case of an emergency.

13. Changes to the Terms

Evalyo reserves the right to modify these Terms at any time. Users will be informed of substantial changes at least fifteen (15) days before they take effect, by email or via a notification on the Platform. Continued use after that date constitutes acceptance of the new conditions.

14. Governing law and dispute resolution

These Terms are governed by French law. In the event of a dispute, the parties will endeavor to find an amicable solution. Failing that, any dispute relating to the interpretation or performance of these Terms falls within the exclusive jurisdiction of the courts of Paris (France).

In accordance with article L.612-1 of the French Consumer Code, consumers may use a consumer mediator free of charge with a view to the amicable resolution of the dispute.
